Nicole Black

Nicole Marie Black is a member at Cohen|Black Law. She was previously a partner in the Denver office of a national law firm. Nicole has been named by Super Lawyers Magazine® to Colorado Super Lawyers® (2022- 2023) and Colorado Rising Stars® (2018–2021).

Nicole focuses her practice on ethics and professional responsibility defense and commercial/business litigation involving licensed professionals. She understands that when a claim is made against a licensed professional, their reputation and livelihood are at stake. Whether the client wants to pursue prelitigation negotiation or vigorously defend against the allegations in court, Nicole actively manages the matter with the client’s objective in mind. Nicole’s representative practice areas include:

  • Nicole defends lawyers and legal professionals, physicians and mental health professionals, and others in regulatory inquiries and proceedings, professional malpractice litigation, and business tort litigation.
  • Nicole represents private companies, directors and officers, and individuals in contractual disputes, business breakup, and business tort litigation. She pursues litigation defense with an active strategy to concurrently mitigate regulatory risk and manage regulatory impact when investigation and inquiry arise.
  • Nicole provides outside ethics opinion advice to law firms, public entities, and private corporations. She provides legal professionals with prescriptive advice on best practices and assists them to address current concerns and to mitigate future risks efficiently and effectively.
  • Nicole is retained by insurance companies to provide opinion advice on insurance coverage and to represent the carriers in declaratory judgment and bad faith litigation related to professional liability, director officer, surplus, and excess lines of insurance.

Nicole is dedicated to improving the legal profession through her leadership on a variety of boards and committees. She is an active leader in the Colorado Bar and Denver Bar Associations and the Sturm
College of Law Alumni Council. Nicole mentors, teaches, and guest presents in service to the community.

Outside of the office, Nicole enjoys running with her Rhodesian Ridgeback, yoga, fly fishing, skiing, cooking for family and friends, and adventure travel.

  • Represented contractor in a case involving failure to deliver commercial goods; prevailed on motion to dismiss all claims for lack of personal and subject matter jurisdiction.
  • Represented excess insurance carriers in insurance coverage litigation involving third-party claims by primary carrier of bad faith related to settlement of the underlying claims; successfully obtained dismissal of all claims with prejudice.
  • Represented property manager and property owner of a large residential apartment community on claims involving professional negligence and premises liability; successfully defeated class certification.
  • Successfully defended seller of business in a commercial arbitration involving allegations by buyer of fraudulent transfer and various business torts.
  • Represented captive insurance agency in bad faith litigation alleging failure to obtain appropriate insurance coverage for an insured; successfully obtained motion to dismiss all claims, with prejudice for failure to state a claim.
